1. Acceptance of Terms

By accessing or using sqftph.com ("the Platform"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree, do not use the Platform. These Terms apply to all visitors, registered users, agents, and administrators.

2. Description of Service

SqftPh is an online real estate marketplace that allows licensed real estate agents and property owners ("Listers") to publish property listings, and allows users ("Buyers" or "Renters") to browse listings and contact Listers. SqftPh is a platform only — we are not a real estate broker, agent, or party to any property transaction.

3. User Accounts

• You must be at least 18 years of age to create an account.
• You are responsible for maintaining the confidentiality of your login credentials.
• You are responsible for all activity that occurs under your account.
• You must provide accurate and complete information when registering.
• We reserve the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or post misleading listings.

4. Listing Rules

All listings published on SqftPh must comply with the following:

• Listings must be for real, existing properties located in the Philippines.
• All information — price, location, size, type, and description — must be accurate and up to date.
• Photos must be of the actual property being listed.
• Listings must not violate any applicable Philippine law, including real estate licensing regulations.
• Duplicate, spam, or misleading listings are prohibited and will be removed.
• Properties listed for sale or rent must be legally available for the transaction — the Lister must have authority to sell or rent the property.

5. Inquiries and Communications

When you submit an inquiry through the Platform, your contact information and message are shared with the agent or lister associated with the listing. SqftPh is not responsible for the content of replies or the outcome of any communications between users and agents. We apply rate limiting on inquiries to prevent spam; abuse of the inquiry system may result in account suspension.

6. No Transactional Warranty

SqftPh does not verify the accuracy of all listing information, the legal status of properties, or the credentials of every agent. We strongly recommend that all parties conduct independent due diligence, including verification of title, permits, and licenses, before entering into any real estate transaction. SqftPh is not liable for any loss arising from reliance on listing information published on the Platform.

7. Intellectual Property

All content on the Platform produced by SqftPh — including the logo, design, software, and compiled listing data — is the property of SqftPh and may not be reproduced, scraped, or distributed without written permission. Content submitted by users (photos, descriptions) remains the property of the submitter; by posting it, you grant SqftPh a non-exclusive, royalty-free license to display and reproduce it on the Platform.

8. Prohibited Conduct

You agree not to:

• Post false, misleading, or fraudulent listings or inquiries.
• Impersonate any person, agent, or organization.
• Use automated tools to scrape, crawl, or harvest data from the Platform.
• Attempt to gain unauthorized access to any part of the Platform or its infrastructure.
• Use the Platform to send spam, unsolicited communications, or phishing messages.
• Circumvent any security or rate-limiting measures on the Platform.

9. Disclaimer of Warranties

The Platform is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Platform will be uninterrupted, error-free, or free of viruses.

10. Limitation of Liability

To the maximum extent permitted by Philippine law, SqftPh shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform, including but not limited to loss of profits, loss of data, or property transaction disputes. Our total liability to you for any claim shall not exceed the amount you paid to use the Platform in the twelve (12) months preceding the claim, or ₱1,000, whichever is greater.

11. Termination

We may suspend or terminate your access to the Platform at any time, with or without notice, for conduct that violates these Terms or is harmful to other users, agents, or the Platform. You may delete your account at any time through your account settings or by contacting us.

12. Governing Law

These Terms are governed by the laws of the Republic of the Philippines. Any disputes arising from or relating to these Terms or the Platform shall be subject to the exclusive jurisdiction of the appropriate courts of the Philippines.

13. Changes to These Terms

We may update these Terms from time to time. We will notify registered users by email of material changes at least 15 days before they take effect. Your continued use of the Platform after the effective date constitutes acceptance of the updated Terms.
